Joe Arpaio—the legacy of hate

Once upon a time, not so long ago, in a place not so far away, there was a land ruled by Joe Arpaio. Maricopa County, Arizona in the 1990s and 2000s. If you were brown, you would be caught for anything and everything. If you were lucky to be put in brick and mortar jails, you would be given stale bread and milk, and moved constantly and not be given time to sleep. Coffee and TV were banned in those jails. But if they are going to lock you up for a long time for say drinking and driving, the jails will be overfilled. Then you would be put in one of Araipo’s tents. No matter the weather in the Arizona desert, you would be placed in a tent with just a pink underwear beneath your prison garb. Cruel? Racist? Yes, it was unequal justice. But Joe Araipo thought he was above the law.
In the Mid 90s Joe Arpaio gained enormous popularity in the State. He also increased the cruelty standard. He was sued by the Justice Department for wrongful death in 97, and settled with the family for 8.25 million.
The cruelty continued to rise. Araipo installed webcams in jails, including those of female inmates using the bathroom. Of course those web cams generated millions of views and strengthened Joe’s support in Arizona. Luckily however in 2004, a court ruled that those webcams violated the rights of pre trial detainees who have not yet been convicted.
In 2007, Arpaio turned his hatred full force towards Mexicans, jailing anyone who was brown. A Mexican man, on a valid visa was detained and sued Arpaio. The ACLU went on to have a class action lawsuit against Arpaio for racially profiling Mexican people.
In 2012, the Justice Department also sues Arpaio and so does the ACLU. Arpaio then launches an “investigation” that Obama’s birth certificate is not legitimate. He also of course supports Trump in 2016.
Also in 2016, he loses his reelection to the former police Chief in Maricopa County. Following a pattern that is uniquely Trump’s Arpaio does not produce documents —the first one to not do so in 50 years. He gets convicted, but Trump, his guru pardons him.
Had he served his jail sentence even for 6 months, the sense of justice that the community wanted would be served. But Trump has no desire to unite this country, he is interested in being loyal to his criminal friends. And so the sense of injustice remains, and this is how, Joe Arpaio will be remembered.

Recent Trends in Business Immigration

Much has been said about undocumented Immigration, Sanctuary cities etc; but we hardly hear about business Immigration. The recent trends in Business Immigrations are:

The recent Request for Evidence are given for Wage level 1 rates.
Pro: We do need higher level Professionals in the US instead of entry level professionals.
Con: Employers for New H-1B don’t know who they are getting and how they will work. Its difficult to promise them higher wages without seeing their performance
Solution: Do the lottery before we apply. That way we know how much to pay or whether to even employ that person
However for petitions with a higher wage, are getting approved.
Although the standards are same, the burden of proof (which the applicant has) seems to have increased. Again small Companies are at a disadvantage compared to large companies. However Requests for Evidence are also being doled out for larger publicly traded Companies

PERM-Labor Certification

Right now, if one applies correctly, perms are getting certified in about 5-6 mts. Same with I-140. Not seeing increase in audits.

I-485 Adjustment of status

Although not more difficult, Adjustments both Employment and Family based are taking a lot longer to process.

Leading Republican Opposed to Trump’s Latest Plan to Cut Legal Immigration in Half

President Trump has recently proposed the RAISE bill, which would cut legal immigration in half by greatly reducing family-based immigration (limited to only spouses and children) and eliminating the diversity visa lottery (50,000 green cards issued annually).  In addition, the plan would implement a merit-based program that favors immigrants who have advanced skills, are self-supporting financially, and have mastery of the English language.  The President claims this plan mirrors the immigration system in Canada.

However, there are several flaws to the RAISE bill.  First, by focusing only on advanced skills, many needed legal immigrants who don’t possess advanced skills would be excluded and cheating would increase. Republican Senator Lindsay Graham, who is strongly opposed, explains,

“Unfortunately, the other part of this proposal would reduce legal immigration by half, including many immigrants who work legally in our agriculture, tourism and service industries.

“South Carolina’s #1 industry is agriculture and tourism is #2. If this proposal were to become law, it would be devastating to our state’s economy which relies on this immigrant workforce.”

Senator Graham further adds, “It incentivizes more illegal immigration as positions go unfilled.  After dealing with this issue for more than a decade, I know that when you restrict legal labor to employers it incentivizes cheating.”

Second, most immigrants are already barred from receiving Federal benefits under existing law during their first five years in the United States, and thus must be able to support themselves.  Third, in an ever-increasing global economy, immigrants with multi-language skills are even more valued.  Finally, even Canada’s merit-based immigration system allows extended family members to immigrate, not just spouses and children.

President Trump’s RAISE plan is highly unlikely to have a positive economic effect on America.  Instead, it will only increase the difficulty for American businesses and its communities to remain competitive in the world economy.
